Terms of Service

These Terms of Service (the "Terms") set forth the rights, obligations, responsibilities, and other necessary matters between Metafrics Inc. (the "Company") and users in relation to the use of the Company's HTML5-based mobile game services (the "Services").

Article 1 (Purpose)

The purpose of these Terms is to stipulate the rights, obligations, responsibilities, and other necessary matters between the Company and users regarding the use of the Services provided by the Company.

Article 2 (Effectiveness and Amendment)

  1. These Terms become effective when posted within the Services or on the Company's web pages.
  2. The Company may amend these Terms within the bounds permitted by applicable laws and regulations.
  3. If the Company amends these Terms, it will provide prior notice by specifying the effective date and the reasons for the amendment.
  4. Users who do not agree with the amended Terms may withdraw from the Services. Continued use of the Services after the effective date of the amended Terms constitutes acceptance of the amendments.

Article 3 (Unstipulated Matters)

Matters not stipulated in these Terms shall be governed by applicable laws and regulations and the Company's policies, including operating policies.

Article 4 (Definitions)

  1. "Services" refers to the HTML5-based mobile games and all related services provided by the Company.
  2. "User" refers to both Members and Non-members who use the Services.
  3. "Member" refers to a person who has agreed to these Terms and created an account to use the Services.
  4. "Non-member" refers to a person who uses the Services without signing up for an account.

Article 5 (Service Provision)

  1. The Company provides the following services:
    • Game services
    • Digital goods and game items
    • Other services determined by the Company
  2. The Company may add or change the content of the Services as necessary for operation.

Article 6 (Service Suspension)

  1. The Company may temporarily suspend the Services in the following cases:
    • System maintenance or inspection
    • Server failures or network issues
    • Force majeure events such as natural disasters
  2. In such cases, the Company will provide prior notice; however, if urgent, notice may be provided after the fact.

Article 7 (Sign-Up & Account Management)

  1. Users sign up for the Services in accordance with the procedures established by the Company.
  2. Users are responsible for managing their account information and may not transfer or lend their account to any third party.
  3. Users must immediately notify the Company if they become aware of any theft or unauthorized use of their account.

Article 8 (Personal Information Protection)

The Company protects users' personal information in accordance with applicable laws and regulations and specifies matters regarding collection, use, provision, retention, and destruction of personal information in its Privacy Policy.

Article 9 (User Obligations)

Users must not engage in any of the following activities:

  • Stealing another person's account or personal information
  • Hacking into the Company's systems or networks
  • Using illegal programs or exploiting bugs
  • Infringing upon the intellectual property rights of the Company or third parties
  • Posting or distributing illegal or harmful content
  • Interfering with the Company's business operations

If a user violates the above prohibitions, the Company may take necessary measures such as restricting use of the Services, suspending the account, and/or claiming damages.

Article 10 (Company Obligations)

  1. The Company shall endeavor to provide stable and continuous Services.
  2. The Company shall handle user complaints and requests promptly and appropriately.
  3. The Company shall comply with applicable laws regarding the protection of users' personal information.

Article 11 (Game Items & Content)

  1. Game items and content are intangible digital content provided in accordance with the Company's policies.
  2. The Company may freely change the performance of items/content and the method of provision.
  3. Items that have already been used are non-refundable, except where a refund is required under applicable laws.

Article 12 (Payments & Refunds)

  1. Payments for the Services are made through the payment methods supported by the user's device.
  2. Users may request a refund for payment errors in accordance with the Company's refund policy.
  3. Due to the nature of digital content, used items are non-refundable.
  4. Payments made by minors without consent of their legal representative may be cancelled in accordance with applicable laws.

Article 13 (Advertisements)

The Company may display advertisements within the Services, and users agree to exposure to such advertisements.

Article 14 (Copyright & Intellectual Property)

  1. Copyright and intellectual property rights for the Services belong to the Company or rightful owners.
  2. Users may not use the content beyond the scope permitted by the Company or provide it to third parties.

Article 15 (Termination & Withdrawal)

  1. Users may request withdrawal from the Services at any time, and upon withdrawal, accounts and owned items cannot be restored.
  2. The Company may restrict or terminate a user's access to the Services if the user violates these Terms or causes serious disruption to the Services.

Article 16 (Disclaimer)

  1. The Company is not responsible for service interruptions caused by force majeure such as natural disasters, system failures, or communication outages.
  2. The Company is not responsible for damages caused by the user's own actions or negligence.
  3. The Company bears no responsibility for disputes arising between users.

Article 17 (Damages)

If a user causes damage to the Company by violating these Terms, the user must compensate the Company for such damages.

Article 18 (Governing Law & Dispute Resolution)

  1. These Terms are governed by the laws of the Republic of Korea.
  2. Any disputes arising from or in connection with the Services shall be resolved through the competent courts or authorities of the Republic of Korea.

Addendum

These Terms shall take effect on January 1, 2025.
